Dos & Don’ts When Pulled Over

When a person is pulled over for possible DUI (driving under the influence) they will be immediately under suspicion by law enforcement. Everything they say and every move they make will be closely monitored. There are several things however that a person may do that may help them in the long run if they are arrested and charged with DUI.

Dos & Don’ts When Pulled Over:

  • Do pull over when stopped.
  • Do turn off your vehicle.
  • Do keep hands on the steering wheel at all times.
  • Do not step out of your motor vehicle if requested.
  • Do provide law enforcement with your driver’s license, registration and insurance or any other documents requested.
  • Do remain polite.
  • Do demand to speak with a Santa Monica DUI defense lawyer immediately.
  • Do not discuss whether or not you are under the influence with law enforcement - you have the legal right to remain silent.
  • Do politely refuse any field sobriety tests.
  • Do not agree to a PBT (preliminary breath test), (only take a breath test at station).

  • Do not sign any papers or documents at the police station other the DMV Hearing Request Form and the DUI ticket (signing ticket is in no way an admission of guilt).
