  • An underage driver who operates a motor vehicle with a blood alcohol concentration of .05% to less than .08% will face an infraction and may face license suspension for one year, a $100 penalty for a first offense and completion of a three-month alcohol program.
  • A driver under 21 who drives with a blood alcohol concentration of .08% or greater will face the same misdemeanor charges and penalties that a driver over the age of 21 will face: imprisonment, fines, license suspension, etc. The underage driver will also face a conviction and the penalties associated with the two other offenses listed above.
